If you are a foreign domestic helper, you can apply for extension of stay, including contract renewal and completion of the remaining period of the current contract sponsored by the same employer, or apply for a change of employer. This page provides information relating to the extension of stay for the same employer or a new employer, the application forms and supporting document needed, online booking appointment, application status enquiry, termination of an employment contract, change of residential address and special circumstances for driving duties.

Where to Apply

You can apply for an extension of stay either at Immigration Headquarters or at relevant Branch Offices throughout Hong Kong.

All applications must be made in person, by you or your employer, or through an authorised representative.

Applications at Branch Offices

You can also submit your application for contract renewal and completion of the remaining period of the current contract sponsored by the same employer at one of the five applicable Branch Offices.

When to Apply

Employment with the same employer

Normal contract renewal (after two years of continuous employment)

If you wish to renew your employment contract with your existing employer, you must submit a fresh application in person or through an authorised person. With effect from 12 July 2010, application from Foreign Domestic Helpers for extension of stay sponsored by the same employer for contract renewal and completion of the remaining period of the current contract can be submitted in person, by post, drop-in or by online submission. You must apply eight weeks before the expiry of your existing contract. For postal, drop-in or online submission, you will normally be notified by letter within 10 working days upon receipt of all necessary documents for collection of the extension visa label with payment of an extension fee. For in person application, you will collect the approved extension visa label with payment of an extension fee on the same day.

Online Submission

You can also submit your application online through the following service.

Foreign domestic helpers are required to take home leave upon expiry of their existing contracts and before the commencement of new contracts. Subject to mutual agreement between you and your employer, an extension of stay may be made to defer that home leave.

Change of employer

Change employer within the two-year contract

If you wish to take up employment with a new employer after the termination of a contract, you must return to your place of origin and apply to the Director of Immigration for a new employment visa. Applications to change employer within the two-year contract will not, as a rule, be approved.

Change employer at the end of the two-year contract

At the end of your two-year contract, you can apply for a change of employer in person at Immigration Headquarters in the same manner as contract renewal with the same employer.

Application Forms

You and your employer must submit completed and signed forms ID988A & ID988B (ID988B is not required for extension of stay for completion of the remaining period of the current contract). These forms can be obtained free of charge from the Immigration Department Headquarters and the Immigration Branch Offices. They can also be downloaded through the following links.

Supporting Documents

The type of supporting documents you need will depend on the situation in which you are applying to extend your stay.

 Normal Contract Renewal

If you are applying for contract renewal after completion of a 2-year contract in person either by walk-in or online appointment booking, you should provide:

  • Visa/Extension of Stay Application Form for Domestic Helper from Abroad (ID988A)
  •  Application for Employment of Domestic Helper from Abroad (ID988B)
  •  Original copy of your new Employment Contract (ID407)
  •  Your valid travel document.

Proofs of your employer's financial position and residential address are not required, provided that there is a confirmation that your employer's average monthly household income remains no less than HK$15 000 (for each domestic helper to be employed) and there is no change in the residential address since the last contract.

If you submit your application by post, drop-in or online submission, you should provide:

  • Visa/Extension of Stay Application Form for Domestic Helper from Abroad (ID988A)
  •  Application for Employment of Domestic Helper from Abroad (ID988B)
  •  An original copy (for online submission, a scanned copy) of your new Employment Contract (ID407)
  •  Copies of your valid travel document including the pages showing your personal particulars, photo, passport validity, latest visa label and latest landing endorsement

If you submit your application online, please take your original employment contract (notarised, if so required by the local consulate) for inspection upon collection of the extension label.

 

Change of Employer

If you are changing your employer, you must submit your application in person to the Immigration Department either by walk-in or online appointment booking. You should provide:

  • Visa/Extension of Stay Application Form for Domestic Helper from Abroad (ID988A);
  •  Application for Employment of Domestic Helper from Abroad (ID988B)
  •  Original copy of your new Employment Contract (ID407)
  •  Original and copy of your valid travel document
  •  A copy of your Hong Kong identity card, if any
  •  A copy of your employer’s identity card or passport
  •  A copy or copies of proof of your employer’s financial position
  •  Proof of your employer’s residential address (both original and copy)
  •  A release letter from your current employer showing the date of expiry or termination of your contract

Online Appointment Booking

Termination of an Employment Contract

If you or your employer chooses to terminate your employment contract, you should notify the Director of Immigration in writing within seven days of the date of termination. Notification can be made by submitting a completed form ID 407E or a letter.

Change of Residential Address

If the address you have registered on employment contract is no longer valid or there is any change to the Schedule of Accommodation and Domestic Duties of the employment contract, you should notify the Immigration Department by completing form ID 407G.

If the new address is a flat in a housing estate run by the Housing Department or the Hong Kong Housing Society, your employer should produce:

  •  A letter of consent from the appropriate authority granting permission for you to reside in the premises
  •  A copy of the tenancy agreement

Special Circumstances for Driving Duties

If you apply to extend your stay and your employer requests you to undertake driving duties, you may be granted permission to do so under special circumstances. As foreign domestic helpers are not usually permitted to perform driving duties, applications must be made to the Director of Immigration for special permission relating to driving duties that are incidental to and arising from domestic duties.
