Consultation Paper on the Proposed Review of the Class Licence for Offer of Telecommunications Services under Section 8(1)(aa) of the Telecommunications Ordinance (Cap. 106)

Brief Description :

To ensure that the regulatory regime of the Class Licence for Offer of Telecommunications Services under section 8(1)(aa) of the Telecommunications Ordinance (Cap. 106) (“CLOTS”) remains up-to-date in view of market developments and that consumer interests will be better protected thereunder, the Communications Authority (“CA”) is seeking views and comments from the public on the proposed variation to the conditions of the CLOTS.

How the major Business Group(s) will be affected by the new regulations/ administrative measures and procedures under consultation:

 

It is proposed that (i) the CLOTS licensees, either all or only those providing certain telecommunications services with customer base exceeding a certain threshold as to be decided by the CA having regard to all the comments and views received from the public in the consultation, should be required to register with the CA before the commencement of offering any telecommunications services, (ii) the CLOTS licensees concerned should provide updated information to the CA as necessary, and (iii) in light of the alignment of the different regulatory requirements of different telecommunications licences (including Unified Carrier Licence, Services-Based Operator Licence or the CLOTS), the CLOTS licensees should comply with all the licence conditions of the amended CLOTS and the relevant regulatory requirements.
